Terms and Conditions – MotoVia

These Terms and Conditions govern the rights and obligations between MotoVia s.r.o., Company ID: 12874591, with its registered office at U Motoparku 12, 110 00 Prague 1, e-mail: info@motovia.cz, phone: +420 777 123 456 (hereinafter referred to as the “Seller”), and the customer (hereinafter referred to as the “Buyer”) in the sale of motor vehicles and related services.


1. Introductory Provisions

These terms apply to all vehicle sales conducted via the MotoVia website, in person at the premises, or through electronic communication.

By confirming an order or signing a contract, the Buyer acknowledges that they have read and agree to these terms.


2. Vehicle Offer

All information about vehicles listed on the website is for informational purposes only.

The Seller reserves the right to change or modify the offer without prior notice.

Photos may be illustrative; the actual condition of the vehicle is always specified in the description or during a personal inspection.


3. Vehicle Reservation

The Buyer may request a vehicle reservation via a form, phone, or e-mail.

The reservation becomes valid only after confirmation by the Seller.

The Seller may require a refundable deposit, which will be deducted from the purchase price.


4. Purchase Agreement

The purchase agreement is concluded by the signature of both parties or by order confirmation.

The agreement includes identification of the vehicle, price, condition, equipment, and other terms.

The Buyer is obliged to familiarize themselves with the vehicle’s condition before signing the contract.


5. Price and Payment Terms

The vehicle price is stated including VAT unless specified otherwise.

Payment can be made via bank transfer, cash, or another agreed method.

The vehicle will be handed over only after full payment has been received.


6. Vehicle Handover

The vehicle is handed over to the Buyer at the Seller’s premises or another agreed location.

The Buyer is obliged to inspect the vehicle upon receipt.

By signing the handover protocol, the Buyer confirms that the vehicle was received in a condition consistent with the agreement.


7. Warranty and Liability for Defects

For used vehicles, the warranty is governed by the Civil Code.

The Seller is responsible for defects that existed at the time of handover.

Normal wear and tear is not covered by the warranty.

The Buyer must report defects without undue delay.


8. Complaints

Complaints must be submitted in writing via e-mail to info@motovia.cz or in person.

The Seller will assess the complaint and propose a solution in accordance with the law.

Complaints do not apply to defects caused by improper use, neglected maintenance, or vehicle modifications.


9. Withdrawal from the Contract

The Buyer may withdraw from the contract in cases provided by law.

For in-person vehicle purchases, the 14-day withdrawal right applicable to e-shops does not apply, as this involves goods that cannot be returned without wear.

In case of withdrawal, the Buyer must return the vehicle in its original condition.


10. Personal Data Protection

The processing of personal data is governed by the Privacy Policy available on the MotoVia website.

The Seller processes data solely for the purpose of order fulfillment, communication, and compliance with legal obligations.


11. Liability and Limitations

The Seller is not liable for damage caused by improper use of the vehicle.

The Seller is not responsible for damages caused by the Buyer after taking possession of the vehicle.

Information on the website may contain technical inaccuracies, which will be continuously updated.


12. Final Provisions

The Seller reserves the right to update these terms at any time.

The valid version is always available on the MotoVia website.

These terms come into effect on the date of publication.
